Obligatory Cookie & Tracking Notice

By continuing to use Playsheet, you accept these Terms of Service as well as our cookie and tracking policy. To be fully transparent (and because we legally have to tell you), we have minimal, deanonymized tracking in place via Google Analytics to understand how people use the app. This is common for most websites—we just want to see if you're actually practicing or immediately rage-quitting because the song was too hard.

1. Acceptance of Terms

By accessing, downloading, installing, or using Playsheet ("Service"), whether or not you become a registered user ("User", "You", "Yourself", "Your"), you agree to be bound by these Terms of Service, which you acknowledge that you have read and understood.

2. Description of Service and Beta Status

Playsheet provides tools for piano learning, sheet music visualization, and midi connectivity. The Service is currently in an Alpha/Beta state. This means:

  • The Service may contain bugs, errors, and other problems that could cause system or other failures and data loss.
  • The Service may not operate continuously or be available at all times.
  • We may clear the database, reset user progress, or modify features without prior notice as part of the development process.

You acknowledge that the Service is experimental and not intended for mission-critical use.

3. User Accounts and Security

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account and the information you provide.
  • Immediately notify us if you discover or otherwise suspect any security breaches related to the Service.

4. User Content and Conduct

Ownership: You retain all rights and ownership in your content. We do not claim any ownership rights in your content.

Responsibility: You are solely responsible for all content that you upload, post, email, or otherwise transmit via the Service.

Prohibited Content: You agree not to upload, post, or otherwise transmit any content that:

  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
  • Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

5. Intellectual Property Rights

Service Content: All content, design, graphics, compilation, magnetic translation, digital conversion, and other matters related to the Service are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights.

DMCA Compliance: We respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us immediately.

6. Privacy Policy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PLAYSHEET EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PLAYSHEET MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT PLAYSHEET SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF PLAYSHEET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE.

9. Indemnification

You agree to indemnify and hold Playsheet, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of these Terms of Service and/or arising from a breach of these Terms of Service and/or any breach of your representations and warranties set forth above.

10. Modifications to Service

Playsheet reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Playsheet shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

11. Data Preservation Warning

No Backups: The Service is hosted on non-redundant infrastructure. We make no guarantees regarding data persistence. Your data may be deleted, corrupted, or lost at any time.

User Responsibility: You are strongly encouraged to maintain your own local backups of any sheet music files, compositions, or other data you upload to the Service.

12. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.

13. Severability

If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect.

14. Third Party Software

The Service may contain or be provided with open source software. Each item of open source software is subject to its own applicable license terms, which can be found in the application credits or documentation.
